Terms of Service
These Terms set out the conditions and procedures for using the website and related services provided by 1EdTech Korea, together with the rights and obligations of users and of the Organization.
Items highlighted as [TO BE CONFIRMED] must be finalized before publication.
This English text is provided for convenience. The Korean version of these Terms is the authoritative text, and it prevails in the event of any discrepancy.
Article 1 (Purpose)
These Terms govern the use of the website (the "Service") operated by 1EdTech Korea (the "Organization"), setting out the rights, obligations and responsibilities of the Organization and of users, and the conditions and procedures for using the Service.
Article 2 (Definitions)
The terms used in these Terms have the following meanings.
- "Service" means all services provided by the Organization through the website, including standards content, membership information, the resource library, newsletters and event information.
- "User" means any person who accesses the Service and uses it under these Terms.
- "Member" means a person who has provided personal data to the Organization, registered an account, and may use the Service on a continuing basis.
- "Member organization" means an institution, company or body that has acquired membership under the Organization's articles of association and membership scheme.
- "Posting" means any information a user posts on the Service, including text, documents, images and links.
- "Source content" means works published by 1EdTech Consortium, including specification documents and web pages.
Terms not defined here have the meaning given by applicable law and by the guidance published for each service.
Article 3 (Effect and Amendment of these Terms)
- These Terms take effect when they are posted on the Service or otherwise notified to users.
- The Organization may amend these Terms to the extent that doing so does not contravene applicable law.
- Where these Terms are amended, the effective date and the reason for the amendment will be posted on the Service at least seven days before that date. Where the amendment is unfavourable to users, it will be posted at least 30 days in advance.
- A user who does not agree to the amended Terms may stop using the Service and request withdrawal of membership. If a user continues to use the Service after the amendment has been announced without expressly objecting, the user is deemed to have agreed to the amended Terms.
Article 4 (Services Provided)
The Organization provides the following services. Some are released in stages, and the release date of each is announced on the Service.
- Korean-language content about 1EdTech standards (translations and summaries) and guidance to the original sources
- Membership information and support for the application process, including requesting and delivering application forms
- Member-only materials and reports
- Information about and registration for events and seminars
- Newsletters and similar informational communications
- Any other service determined by the Organization
Article 5 (Provision and Suspension of the Service)
- As a rule, the Service is provided 24 hours a day, every day of the year.
- The Organization may temporarily suspend all or part of the Service where this is unavoidable — for system maintenance or replacement, equipment failure, loss of communications, natural disaster and the like. In such a case the Organization will give notice in advance, or, where advance notice is impossible, without delay afterwards.
- The Organization may change or discontinue the content of the Service, and will announce the reason and date of any such change or discontinuation in advance.
Article 6 (Accounts and the Application Process)
- Membership is formed when a user agrees to these Terms, applies for membership, and the Organization accepts the application.
- Membership of an organization follows the Organization's articles of association and membership scheme. Application forms are sent only after ownership of the email address has been verified.
- The Organization may refuse an application, or terminate the agreement afterwards, where the applicant has used another person's identity, entered false information, interfered with the proper operation of the Service, or otherwise breached applicable law.
- Members are responsible for managing their own account credentials and must not allow a third party to use them. A member who becomes aware of misuse or unauthorized use of an account must notify the Organization immediately and follow its instructions.
Article 7 (User Obligations)
Users must not do any of the following.
- Register false information when applying for membership or updating their details
- Misappropriate another person's information or impersonate the Organization or a third party
- Infringe the copyright or other intellectual property rights of the Organization or a third party
- Deliberately interfere with the operation of the Service, or transmit information that may impair its stable operation
- Use automated means to place an excessive load on the Service or to harvest content in bulk
- Provide or disclose member-only materials to an unauthorized third party
- Any other act that contravenes applicable law or public order and morals
Article 8 (Copyright in Postings and Their Management)
- Copyright in a posting made by a user on the Service belongs to the author of that posting.
- By making a posting, the user grants the Organization a royalty-free right to use it for operating, displaying, transmitting and promoting the Service. The Organization will not alter the substance of a posting without the author's express consent.
- The Organization may delete a posting or restrict access to it without prior notice where the posting contravenes applicable law, infringes the rights of others, or breaches Article 7.
- Copyright and other intellectual property rights in content created by the Organization — Korean translations and summaries of standards, reports, images and the like — belong to the Organization or to the rightful owner. Users must not reproduce, transmit, publish, distribute or broadcast such content, or allow a third party to use it, without the Organization's prior consent.
Article 9 (Translation of 1EdTech Source Content and Attribution)
- The names and logos of 1EdTech standards — including 1EdTech, LTI, OneRoster, QTI, Open Badges, CASE and Caliper — are trademarks or registered trademarks of 1EdTech Consortium, and copyright in the source content belongs to 1EdTech Consortium.
- The Korean standards content provided by the Organization is derivative material that translates or summarizes 1EdTech source content. Each piece of content states the title and source of the original, a link to it, and the fact that it is a translation or summary.
- Where a translation or summary differs from the original, the source content published by 1EdTech prevails. Technical decisions and conformance checks must be based on the original specification.
- A user who quotes or reuses the Organization's translated or summarized content must attribute it to 1EdTech Korea together with the address of the page concerned, and must also state the source of, and link to, the original.
- The Organization periodically checks whether source content has been revised and updates its translations accordingly; there may, however, be an interval between a revision of the original and the update of the translation.
Article 10 (Disclaimers)
- The Organization is not liable where it cannot provide the Service because of force majeure, such as a natural disaster, communications failure or power outage.
- The Organization is not liable for any impairment of the Service that is attributable to the user.
- Information about standards provided by the Organization is reference material intended to aid understanding. It does not warrant that any particular product or system conforms to a standard or will obtain certification; conformance decisions and certification follow 1EdTech's official processes.
- The Organization does not warrant the accuracy or reliability of external links published on the Service or of information provided by third parties.
- The Organization is under no obligation to intervene in a dispute arising through the Service between users, or between a user and a third party, and is not liable for any resulting damage.
Article 11 (Dispute Resolution and Governing Law)
- The Organization and users will use their best efforts to resolve amicably any dispute arising in connection with the Service.
- These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
- Any litigation between the Organization and a user in connection with use of the Service is brought before the court having jurisdiction under the Civil Procedure Act of the Republic of Korea.
